School and Group Booking Terms & Conditions
All bookings subject to these Terms and Conditions
By submitting your booking you represent to us that you have the authority to make the booking on behalf of your party and that you accept on behalf of your party that the booking is subject to these Terms and Conditions. A contract exists as soon as we issue our Booking Confirmation Form.
AQUA SPORTS SCHOOLS & GROUP BOOKING CONDITIONS
- A booking is confirmed when the invoice and booking form are sent.
- A minimum deposit payment of 50% is due within 30 days of confirmation of booking, or by return if less than 30 days. In the event of cancellation of a booking, notice must be received in writing at least 14 days before the event and cancellation fees will be incurred as follows: • 180 days before event – no charge • 150 days before event – 10% of deposit • 120 days before event – 15% of deposit • 90 days before event – 25% of deposit • 60 days before event – 50% of deposit • 30 days before event – 75% of deposit • 14 days or less event – 100% of deposit.
- In the event of cancellation without written notice the full event fee will be charged.
- Where minimum numbers are booked, we advise clients to book for a realistic number. Notification of final numbers or an increase or decrease in numbers must be received and confirmed by Aqua Sports in writing at least 14 days prior to event. Aqua Sports Company cannot guarantee spaces for extra attendees. Notice of a decrease in numbers greater than 30% of the booking must be received in writing and agreed at least 30 days before activity day or charges will be made for original numbers booked.
- If no prior written agreement has been made, the Company reserves the right to charge for the number of people booked, should fewer students attend on the day.
- Should weather conditions or other circumstances cause cancellation of an event, a mutually convenient date to reconvene will be arranged.
- The Aqua Sports Company has full public liability insurance which covers all activities operated by the company. Personal insurance against loss, damage, injury or accident whilst visiting the site is the responsibility of the client. The Aqua Sports Company accepts no liability for any loss, damage, injury or accident, which is the result of negligence on the part of the client, however caused.
- Clients should be water confident, and able to swim.
- Please give details of any medical conditions in the space provided. Anyone suffering from any medical condition must notify The Aqua Sports Company prior to booking and again on arrival at the Centre. Whilst such medical conditions may not necessarily prevent clients from taking part in activities, The Aqua Sports Company can accept no responsibility for any client's medical condition.
- Parental/Participation consent is the responsibility of the event organiser and must be given for all activities undertaken at The Aqua Sports Company. A signed booking form confirms that consent has been given for all participants.
- Aqua Sports may photograph events and activities for publicity, if you would prefer your school or group not to appear in our literature, please advise our staff.
Terms and Conditions of Lake Usage
General
- All sailors, windsurfers and canoeists must be competent in the prevailing conditions.
- All hirers must be in good health and be able to swim 50 metres.
- All visitors are advised to wear shoes particularly on the water.
- Club Members are personally responsible for:
- ensuring that all guests have read and agreed these terms.
- the conduct on and off the water of his and her guests
- they have sufficient 3rd party insurance.
- All sailors must keep 30 metres from the banks/angling swims.
- All use of the lake by club members will be for non-commercial and enjoyment purposes only.
- Any clients suffering from medical conditions such as diabetes, epilepsy or other such should inform staff before launching.
- Personal insurance against injury, accident or loss while undertaking a course or hiring a board is the responsibility of the client. The Aqua Sports Company will accept no liability for any such injury, accident, damage or loss howsoever caused.
Courses
- Buoyancy aids must be worn by juniors, youths, beginner windsurfers, all dinghy sailors and canoeist whilst afloat.
- Pupils must complete a booking form and register it with the appropriate fee with Aqua Sports before commencing a course.
- Pupils may only be taught be Aqua Sports staff as part of a properly organised and registered course.
Hirers
- The hirer shall be responsible for the first £25 of any damage or loss to any craft or equipment.
- Personal insurance against injury, loss or accident while hiring equipment is the responsibility of the client. The Aqua Sports Company will accept no liability for any such injury, accident, damage or loss howsoever caused. Under The Aqua Sports Company policy the client is only covered for loss or damage to the equipment hired from The Aqua Sports Company.
- Craft may only be hired by those with RYA or BCU proficiency.
- Under certain conditions, at the discretion of the Aqua Sports Company, hirers may be allowed to hire without certification if they are deemed competent by the Aqua Sports Company staff.
Own Equipment Members & Day Launch Users
- Payment for the day must be received before launching.
- Refunds will not be given.
- Minimum RYA/BCU proficiency required, certificate or as judged by Aqua Sports staff.
- Only non-commercial usage allowed.
- No tuition allowed other than that carried out by the Aqua Sports Company staff.
- All users must have adequate insurance which should also cover third party liability insurance of at least £1,000,000.
INSURANCE
The Aqua Sports Company Limited shall not be liable for any loss or damage caused by events or circumstances beyond our reasonable control (such as extreme weather conditions, the actions of third parties not employed by us or latent defects); this includes loss or damages to vessels, gear, equipment or other goods left with us for repair or storage, and harm to persons entering the premises and/or using the facilities or equipment; customers should ensure that their own personal and property insurance covers such risks.
All members may themselves be liable for any loss or damage caused by them, their crew or vessels. Any vessel, gear, equipment or other goods are left with us at the members’ own risk; members should maintain adequate insurance which should also cover third party liability of at least £1,000,000.
BLUE GREEN ALGAE NOTICE
Occasionally activities are suspended due to blue green algae levels or there are large areas of scum formations. We apologise for the inconvenience. When levels are higher than our recommended safety threshold for water contact activities (20,000 cells/ml), all junior activity and adult windsurfing are suspended. When levels are below World Heath Organisation advisory levels for non-water contact activities (100,000 cells/ml), sailing activities will be allowed under the following conditions:
- There are no scum formations in the sailing areas.
- Sailors are advised that they may sail if they are at a competent standard not to capsize in the conditions.
- In the event of accidental capsize sailors are advised to try not to drink any scum and to shower off after their session.
- All lake users sail or windsurf or paddle at their own risk. The Aqua Sports Company will accept no liability for any illness that might have been caused by Blue Green Algae
